REAL ESTATE AUCTION TERMS AND CONDITIONS

A complete Purchase Agreement with all terms and conditions of this Auction is available in the Bidders Packet; the following is only an overview.

Registration Requirements: Bidders must first sign and accept all disclosure forms including seller's disclosure and waiving the opportunity for inspections. All inspections must be completed prior to Auction. Bidders must register for a special Real Estate Buyers number day of Auction and complete an opening bid form.

Real Estate Deposit Requirements: If you are the successful bidder and your bid is accepted you will immediately need to execute the Purchase Agreement with a nonrefundable deposit of $15,000. Your bid is not contingent upon being approved for financing. Please arrange financing prior to Auction and be able to pay cash at closing.

Property Disclaimer: The property is being offered "AS IS, WHERE IS" with no warranties of any type express or implied. All information advertised or stated has been derived from sources deemed reliable, but is not guaranteed. Buyers shall rely totally on their inspection of the property and records. Minimum Bid: The minimum bid for this propety is $200,000.

Buyer Premium: A 10% Buyers Premium will be added to the final bid to create the purchase price. Please take this into consideration when bidding.

Possession: Possession will be at closing

Closing: Closing will occur within 45 days of Auction at the Plainfield Transnation Office. Balance of purchase price will be due at closing.

Deed: Seller shall supply an owner's title insurance policy in the amount of the purchase price.

Easements: Sale of property is subject to all easements of record.

Closing Costs: The buyer will incur standard closing costs of approx $350.

Survey: A new survey has been provided by the seller at no cost to the buyer and is to be accepted by the buyer. New survey will be available soon.

Real Estate Taxes: Taxes shall be prorated to the date of closing.

Billboards: There are 2 billboards on the property on lease to Lamar Advertising Company. A new 10 year lease has been sign for a yearly rent of $500 for the pair. This amount will be prorated to closing date.

PA 116: Property is currently in a Farmland Development Rights Agreement with the State of Michigan expiring December 31st 2023.

Broker Participation: Broker/salespersons are invited to participate with their buyer clients. A 3% commission will be offered on the final bid. Written pre-registration is required 24 hours prior Auction day; no oral registrations will be accepted. Agents who fail to register will not be entitled to a co-op commission.

Well & Septic Information: There will be no well and septic inspection provided by the seller. The well and septic are both older, but were in working order as of last fall. The property is being offered "AS IS, WHERE IS" with no warranties of any type.

Prospective bidders are advised to avail themselves to records of the Township of Ashland, Newaygo County and the State of Michigan and to make inspections of the premises on their own behalf; consulting whatever advisor they may feel appropriate.

The following information is for buyers that will be represented by a buyers agent.

A 3% commission on the high bid will be paid to a licensed Michigan Brokers whose prospects pay for and close on the property. Commission is tabulated from the high bid before the premium is added. The broker must first register their prospect in writing by sending an email to artsmithauctioneers@gmail.com. Broker or agent must inspect the property with their client and attend the Auction with the prospect and sign in. There can be no exceptions to this procedure. No oral registrations will be accepted.
